اتفاقية معالجة البيانات Data processing agreement

تُكمِّل هذه الاتفاقية شروط استخدام «مساعد» وتنطبق كلّما عالج «مساعد» بيانات شخصية نيابةً عنك: أنت — التاجر أو شركة التوصيل — المتحكّم ببيانات عملائك، و«مساعد» المعالِج الذي ينفّذ التوصيل بها. تسري بمجرّد إنشاء حسابك، ولا تحتاج إلى توقيع منفصل. This agreement supplements the Msa3d terms of use and applies whenever Msa3d processes personal data on your behalf. You — the merchant or the delivery company — are the controller of your customers' data; Msa3d is the processor that carries out the delivery with it. It takes effect when your account is created and needs no separate signature.

٢. التزامات «مساعد» 2. What Msa3d undertakes
- بتعليماتك وحدها. لا نعالج بياناتك لغرض آخر، ولا نبيعها، ولا نستخدمها في إعلانات، ولا ندرّب عليها نماذج. Only on your instructions. We process your data for no other purpose, do not sell it, show no advertising, and train no models on it.
- السرّية. الوصول مقصور على من يحتاجه لتشغيل الخدمة، ومربوط بصلاحيات الدور. Confidentiality. Access is limited to those who need it to run the service, and is bound to role permissions.
- العزل بين المستأجرين. عزل البيانات مفروض في قاعدة البيانات نفسها (Row-Level Security)، لا في كود التطبيق وحده. Tenant isolation. Separation is enforced in the database itself (row-level security), not in application code alone.
- الإبلاغ عن الحوادث. نُخطرك دون تأخير لا مبرّر له، وخلال ٧٢ ساعة على الأكثر من علمنا بخرقٍ يمسّ بياناتك، بما نعرفه وبما فعلناه. Breach notification. We tell you without undue delay, and within 72 hours of becoming aware at the latest, what happened and what we did.
- المساعدة. نساعدك على الاستجابة لطلبات أصحاب البيانات (الاطّلاع، التصحيح، الحذف) وعلى تقييمات الأثر عند الحاجة. Assistance. We help you answer data-subject requests — access, correction, deletion — and impact assessments where needed.
- الحذف أو الإعادة. عند انتهاء الخدمة نحذف بياناتك أو نعيدها إليك بناءً على اختيارك، عدا ما يلزم الاحتفاظ به قانونيًا — وسجلّ الحسابات المالية منها. Deletion or return. When the service ends we delete your data or return it, as you choose, except what must be retained by law — the financial ledger among it.
- الإثبات. نوفّر لك المعلومات اللازمة لإثبات الالتزام بهذه الاتفاقية، ونتيح مراجعةً معقولة بإشعار مسبق. Demonstrating compliance. We give you the information needed to show these obligations are met, and allow a reasonable audit on notice.
٣. المعالجون من الباطن 3. Sub-processors
نستعين بمزوّدين محدودين، ولكلٍّ منهم غرضٌ واحد. نُخطرك قبل إضافة مزوّد جديد، ولك أن تعترض. We use a small number of providers, each for one purpose. We tell you before adding a new one, and you may object.

٤. إجراءات الأمان 4. Security measures
- تشفير النقل (TLS) على كل واجهة عامة. Encryption in transit (TLS) on every public surface.
- تشفير النسخ الاحتياطية (AES-256)، ويُتحقَّق من فكّ تشفير كل نسخة عند إنشائها. Backups encrypted with AES-256, each one verified to decrypt at the moment it is written.
- كلمات المرور مُخزَّنة بـ Argon2id، وتُرفض أي كلمة مرور ظهرت في تسريب عام. Passwords stored with Argon2id, and any password that has appeared in a public breach is refused.
- الأسرار ومفاتيح المتاجر مشفّرة في قاعدة البيانات. Secrets and storefront keys are encrypted at rest.
- سجلّ تدقيق لكل تغيير، وسجلّ حسابات لا يُعدَّل ولا يُحذف. An audit trail for every change, and an append-only financial ledger.

٥. مكان المعالجة 5. Where processing happens
تُستضاف بيانات «مساعد» في مراكز بيانات المزوّد داخل الاتحاد الأوروبي، وقد يعالج بعض المزوّدين أعلاه البيانات خارجها ضمن الغرض المذكور لكلٍّ منهم. Msa3d's data is hosted in the provider's data centres in the European Union; some of the providers above may process data outside it, within the single purpose listed for each.
٦. التغييرات 6. Changes
